Real Estate & Property
The Firm can assist in all areas of real property acquisition, operation, leasing, management, development, construction, renovation, and disposition.
Attorneys assist in the negotiation and preparation of contracts and leases. They prepare closing documents for sales, purchases and loans.
The firm represents numerous private lenders and has assisted institutional lenders in closing loans throughout the state of Florida.
Attorneys work with out of state lenders and their counsel to assist in closing in state commercial real estate loans.
Mr. Infantino and Mr. Raley write title insurance commitments and policies as agents of Attorneys’ Title Insurance Fund, Inc. (the “Fund”). Mr. Infantino has been a member of the Fund since 1975. Closing protection letters are available from the “Fund” to assist in completing these types of services.
Litigation
The Firm’s litigation practice involves providing consultation, advice, pre-trial legal services, trials, and all post-trial matters.
Each attorney can represent clients in the state court system and also assist through alternative resolution methods, including mediation of disputes and arbitration of disputes.
The areas of trial practice include:
- business and commercial matters;
- family law matters – dissolution & child support;
- real estate litigation, disputes with zoning authorities, environmental disputes, and disputes with other governmental agencies;
- employee disputes; and
- administrative litigation involving disciplinary sanctions against a person with a professional license (i.e. real estate brokers, insurance agents and agencies, dentists, doctors, nurses, building contractors).
Mr. Berman was special counsel to the local public transportation authority for eight years to provide defense of vehicle related accident claims arising from incidents involving public transportation vehicles.
Insurance
Mr. Berman provides legal assistance and counseling to insurance agents and agencies regulated by the Florida Department of Insurance.
This area includes general counseling, review of application of insurance laws and administrative rules, rule challenge proceedings, and the defense of agents and agencies in license disciplinary proceedings. He is available to counsel agents in their dealings with the Florida Department of Insurance on matters affecting their licensure.
Dissolution of Marriage – Child Support
Mr. Berman provides legal services for family law related matters including dissolution of marriage, child custody and child support matters. He is available to consult with on matters preliminary to taking action to become married or to dissolve marriage.
Professional Licensing – Administrative Agency Adjudications
Mr. Berman provides consultation and defense for insurance agents and agencies involved in disciplinary proceedings by the Florida Insurance Commissioner’s office.
Mr. Infantino provides consultation and defense of persons involved in disciplinary proceedings against real estate brokers.
Mr. Infantino also provides advice regarding administrative challenges to proposed and existing administrative rules or agency policies that should have been adopted as rules. Mr. Infantino also has provided consultation and legal services on claims dealing with Required Records deficiencies and proposed assessed civil fines for commercial vehicle operators after experiencing Terminal Audits by the Florida Department of Transportation.
Corporations & Business
All of the attorneys in the firm assist in the creation and operation of corporations, limited liability companies, partnerships and joint ventures. Members of the firm can assist in acquisitions, dispositions, real estate, licensing, registration of service marks, general corporate matters, litigation, and alternative dispute resolution.
Elder Law
Mr. Raley provides consultation and legal services with respect.
Probate
Mr. Raley provides consultation and legal services to those persons who have attained probate of estate, including the preparation of living wills, powers of attorney, trusts, wills and related matters. Mr. Raley also represents guardians and can assist in guardianship proceedings.
Bankruptcy
Mr. Raley provides legal consultation, evaluation, and assistance with the filing of personal bankruptcy proceedings.
Mr. Raley also provides assistance to private lenders in the context of bankruptcy proceedings, assisting in having the automatic stays lifted, to allow foreclosure proceedings to occur.
Land Use & Zoning
Mr. Infantino provides legal assistance with persons in evaluating the effect of local government decisions on land use and zoning. These services are available to those who are seeking governmental action on their land or for those who are affected by the governmental action taken on nearby lands.
Mr. Infantino can also assist persons seeking preliminary plat or site plan approvals, through attendance at development review meetings, planning and zoning meetings and county or city governmental approval proceedings. Mr. Infantino can also provide assistance to persons having issues in connection with lakefront property or boat docks (their own or their neighbors).
Public and Private Transportation
Mr. Berman can provide evaluation of public bus carrier liability in bus accident cases.
He has provided the local public transportation authority with the defense and compromise of accident claims arising from incidents involving the equipment and vehicles of the transportation authority.
Mr. Infantino has assisted a regional transportation authority with a recent merger and transfer of assets and related grant, rights, or other items, as part of the restructuring of the authority and its mission.
He also has provided consultation to a South Florida county on the restructuring of its public transportation property. Mr. Infantino has also assisted the local congressional delegation members on regional pubic transportation matters through workshops, personal consultation and meetings. Mr. Infantino has represented private transportation providers in matters of equipment acquisition, general corporate matters, and defending the assessment of a civil penalty resulting from the Terminal Audit conducted by the Florida Department of Transportation.
Affordable Housing
Mr. Infantino has provided advice and consultation to the promoters and developers of renovated affordable housing.
Services include the evaluation and revision of purchase contracts; reviewing trust indentures, loan agreements and official statements; negotiating with bond underwriters and issuers; reviewing title commitments and surveys; and coordinating the use and services of local counsel to provide opinions to the appropriate parties in the issuance of mortgage revenue bonds.
